Shelly’s Party Rental Policy

Release and Acknowledgement of Risks

 

I, the lessee (customer) understand and acknowledge that the activity to be engaged in through my rental of an inflatable, interactive amusement device, and/or any other item being rented brings with it the both known and unanticipated risks to myself , my guests, and to my invites. Those risks include, but are not limited to falling, slipping, crashing, colliding, and could result in injuries, illness, disease, emotional distress, death, and/or property damage to myself and/or my guest and invites

I voluntary release indemnify, hold harmless and discharge Shelly’s Jumpers (the company) from any and all liability, claims, demand actions, or right of action whether personal to me or to a third party which are related to arise out of or are in any way connected with any rental of the unit (bouncer) including those allegedly attributable to negligent acts or omissions. I agree to reimburse any reasonable attorneys fee s and costs which may be incurred by Shelly’s Jumpers in the defense of any of such liability claim, demand, action or right of action.

I acknowledge that I have the adequate home owner’s insurance, tenant insurance or other liability insurance to cover any bodily injury which might occur to myself, my guests, or my invites from the use of the equipment I am renting and I agree to bear the cost of such injuries myself. I agree to bear all cost to the rental equipment that is stolen, lost, and/or damaged and the customer is required to replace and/or repair the equipment rented and will be the property of Shelly’s Jumpers.

Customers agree to have an adult supervise both the equipment and its use at all times while equipment is in the possession of the customer. As et of rules and directions are displayed in front if the bouncer and the driver will also explain the safety rules which I agree to follow and utilize at all times during the operation and use of the unit and/or equipment. The customer understands that no operator has been left with the unit and is solely responsible for the correct and safe operation of this equipment. Customers voluntarily agree to keep and maintain all safety rules that have been explained by the driver and rules listed on bouncer. There must be a clear path to where the unit will be set up. If there is not a clear path, driver will not set up the unit. Driver will not move any items blocking the path. Person renting the unit must move all items blocking path or delivery will be canceled. Bouncers shall be inflated at all times till the driver comes so that the bouncer can be inspected for damage. The equipment shall be located at the address listed below during the rental and shall not be removed. Customer is responsible for all the equipment until it is picked up by the same driver.

The equipment has been inspected before delivery and is in working order. Customer will inspect the equipment with driver to see for themselves that it is in working order and if not should tell the driver what the problem is.. By signing at the bottom, the customer is satisfied with the equipment and accepts it for the duration of the rental agreement. Problems do arise at times and if there is any problem the customer will contact the office so some one can be sent out to repair or take care of the problem.

Our weather policy is that if it rains, winds are blowing strong, and/or it is snowing before the time of your party, we have the right to cancel delivery. If weather is severe, like mentioned before, we have the right to pick up the rental equipment and no refund will be given. We will inform you of this policy over the phone, in person and/or in writing if there is a chance of bad weather in the forecast.

AN ADDITIONAL FEE IS CHARGED FOR DELIVERY DEPENDING ON LOCATION. QUOTATIONS ARE FOR FIRST FLOOR LOCATIONS. ALL EQUIPMENT MUST BE READY FOR PICK UP IN A SINGLE LOCATION. TABLES AND CHAIRS SHOULD BE FOLDED AND STACKED READY FOR PICK-UP IN A PROTECTIVE AREA. LINENS SHOULD BE FREE OF FOOD AND DRY TO PREVENT STAINING AND MILDEW. ALL CHINA, SILVER, UTENSILS, ETC. SHOULD BE RINSED AND FREE OF FOOD AND REPACKED IN DELIVERY CONTAINERS, ITEMS NOT MEETING THESE CONDITIONS WILL BE SUBJET TO AN ADDITIONAL CHARGE.

Shelly’s Party Rentals may charge a small delivery fee for certain items. Rate may vary depending on distance.  Rntus.com customers receive special rates.  Please coordinate with Shelly’s directly after the booking is complete. Your satisfaction is guaranteed.  <<<

If delivery site requires that equipment be taken upstairs, elevator or an excessive walk by our delivery/pick-up crew there will be an additional charge (labor fee).

Normal delivery hours are 9am to 6pm Monday through Friday, delivery at different hours will be charge extra.

I acknowledge and certify that I have sufficient opportunity to read the entire document, that I understand its content and that I execute it freely, intelligently, and with out duress of any kind and agree to it by its terms. I further warrant and represent that I am either the customer named below, or I am authorized and empowered to accept delivery of the equipment and to sign this agreement on their behalf. Further, I agree that I am also binding myself as an additional party to all of the terms and conditions of this agreement. No minor can sign. Person signing must be over 18 years of age. I.D. must be seen by driver. If not seen, driver will not deliver the unit. ID MUST BE CHECKED:

We are determined to provide the best service in the industry. It is the driver responsibility to make sure the bouncer is properly spiked down and in reasonable clean condition. If you feel that the driver has not done satisfactory job setting up the unit, please call us at: 310-736-0720

Rental Equipment Damage Waiver

The Rentus.com Rental Equipment Damage Waiver waives your responsibility for accidental damage to the equipment while in your possession and control. You must still take reasonable precautions to protect the equipment and not intentionally damage the equipment.

The "Rental Equipment Damage Waiver" is optional on all rental equipment. This covers the renter for accidental damage to the rental equipment.

What Waiver Covers:
Limits renter's financial responsibility to 10% of the total cost of repairs or $150 minimum deductible.
Covers up to the stated current market value of the equipment as stated by the owner when listing the equipment on Rentus.com with a maximum of $7500 in total repairs for accident or collision. Renter is responsible for any additional costs over the stated market value or $7500.
Rental Equipment Damage Waiver Exceptions

Even with the Damage Waiver, damage or loss caused by burglary, theft, conversion, misuse, abuse intentional or negligent damage or destruction, or similar causes remain your responsibility including without limitation:
Use or operation of equipment in a manner inconsistent with the manufacturer's instructions, or contrary to the rental contract.
Use or operation of equipment while under the influence of alcohol or drugs.
Loss or damage to accessory equipment such as welding leads, electric cords, bits, batteries, hoses, tires, tubes, or harnesses, etc.
Loss due to inventory shortage, wrongful conversion or any dishonest act by customer or by a person entrusted by customer with the equipment, including customer's employees, sub-contractors or agents.
Loss or damage due to flood, storm, earthquake, or other external factors.
Loss or damage due to overloading or exceeding rated capacity, misuse, abuse, or improper servicing of the equipment.
Seizure or destruction of the equipment by order of a government authority.
All loss or damage of equipment caused by theft, vandalism, or malicious mischief.
Tire repair is the responsibility of the renter.

DAMAGE WAIVER IS NOT INSURANCE Damage waiver is NOT insurance. You are still responsible for all personal injuries or property damage as set forth in the Rental Contract or operation of the equipment. The Damage Waiver is enforced for the same duration as the rental period. A rental period begins when you pick up the rented equipment and ends when the rented item is returned.

SECURITY DEPOSIT: A security deposit will be held. Security deposit is due when rental is booked. The Company may use your deposit to pay any amounts owed to us under this agreement. If the amount of the security deposit is insufficient to satisfy all amounts due then the Renter agrees to pay all charges in excess, either by personal check or cashier's check. Deposit may be used to pay any amounts owed to us under this Agreement.

PROOF OF CONDITION: When picking up the equipment, both the Owner and the Renter must take pictures of at least 4 angles of the equipment item. These pictures must be timed stamped. In order to file a claim, we would need to see those pictures to prove the condition of the equipment when it was delivered to the renter. Failure to have these pictures when presenting a claim may result on the claim to be denied.

LIABILITY INSURANCE: Renter is responsible for all damage or loss you cause to himself or others due to the operation of the rented equipment.
